CHAPTER I Article 1: The International Book Fair Venezuela 2005 Is organized by the National Book Council (Centro Nacional del Libro), that for the effects of these regulations is denominated ORGANISING BODY. Article 2: The International Book Fair Venezuela 2005 is open to the participation of both national and international publishing companies as well as distributors, retailers, literary agents, services related to the graphic arts industries, associations professionals and semi-professionals, both national and/or overseas. It is similarly open to business circles, freelance professionals and those involved in any other activity related to the book world. The places assigned will be at the criteria of the ORGANISING BODY at the moment of registering. The ORGANISING BODY may authorise the participation of companies offering goods or services linked to the publishing or cultural environment: companies providing computer services, videos, posters, discs, educational toys, among others.
CHAPTER II Article 3: Authority for The International Book Fair Venezuela 2005 is exercised by the Presidency of The National Book Council (CENAL). The organization of the event is channelled through the Organizing Body. Article 4: The operating authority is the Superintendent of the Fair, presided over by the Board for the Promotion of Books comprising the group of superintendents designated by the ORGANISING BODY. The function of the Superintendent will be to apply the present Regulations and verify any possible irregularities that may present themselves on the Fair site. Once the irregularity is evaluated and a solution to the problem is not obtained, the Committee of Ethics shall be informed immediately in writing, so that in turn, pertinent measures may be adopted. Article 5: The Committee of Ethics shall be composed of five members, presided over by the Presidency of The National Book Council (CENAL), a representative from the Venezuelan Book Chamber, a representative from the Venezuelan Chamber of Publishers, a representative from la Venezuelan Association of Alternative Publishers (AVEA) a representative from the Association of Graphic Arts Industries of Venezuela. The Committee of Ethics will ensure the faithful compliance of the Regulations and may act with authority or at the bequest of the Superintendent or by any other in accordance with the following functions: a) Knowledge of irregularities which the exhibitor may incur. b) A substantiation of the respective procedures. c) The application of the sanctions stipulated in these Regulations, in the understanding that these decisions are unarguable and under no condition may any compensation be sought as a result of these sanctions from the ORGANISING BODY.
CHAPTER III Article 6: The stands, to which the exhibitor has right, will previously be fixed and made ready by the ORGANISING BODY. The specific features of these will be expressly indicated in the respective leasing contract. It is not allowed to make modifications of any kind to these stands without the previous consent, in writing, of the ORGANISING BODY. Article 7: Sales and promotions must be carried out exclusively within the perimeter of said stand, without encroaching on common space, or of that of other participants. Equally signs and items of publicity should only be placed inside the stand assigned. Article 8: The display or commercialisation of material or articles prohibited by the Venezuelan authorities is not permitted Article 9: The ORGANISING BODY reserves the right of admission regarding application forms and the assignation of spaces. Article 10: Exhibitors may hire one or more stands, which should be adjacent. Article 11: No exhibitor may transfer or sublet his space(s) or services to third parties, nor swap between the spaces assigned. Article 12: The ORGANISING BODY may re-utilise the space of those exhibitors that do not fulfil their obligations, withdraw their participation or fail to occupy said space on the stipulated date, the case of which may be judged in favour of another applicant. In all these cases the exhibitor will lose anything already put down in the leasing process. Article 13: The ORGANISING BODY will publish an Exhibitor's Catalogue that will contain: Name of company Number of stand Publishing line Person-in-charge Location of stand Only publishers who supply information by the dates announced will appear in the Exhibitor's Catalogue. Every exhibitor will receive two copies of the catalogue, free of charge. Article 14: Exhibitors, who wish to host receptions, conferences, press conferences, talks, prize-giving, book presentations or other such activities, should adhere to the regulations indicated in the Exhibitor's Guide and notify the ORGANISING BODY in good time, so as to obtain the respective authorization. Article 15: The ORGANISING BODY reserves the right to reproduce, distribute and authorise a record of the image in its entirety, of the stand, detail of its interiors or exteriors, and the right to commercialise the images obtained. Artículo 16: The ORGANISING BODY will not be responsible for any transactions regarding Customs.
CHAPTER IV Article 17: In the event of any presumed breach, the following procedure will be carried out: The exhibitor occasioning the breach will be notified in writing by the Superintendent. The exhibitor will have the right to make known his reasons for the situation to the Committee of Ethics, also in writing, within 24 hours of the notification. The Committee of Ethics will evaluate the evidence provided, and resolve the consequences. Article 18: Penalties that in any case the Committee of Ethics decides to apply must be notified to the offender within the 48 hours following the date of the decision. Possible sanctions: A scale of fines that may reach up to the total value of the stand occupied, according to the seriousness of the offence. Closure of the stand and immediate eviction, Non acceptance of the exhibitor on future occasions
CHAPTER V Article 19: THE ORGANISING BODY will place security personnel around the whole of the Fair site, but will only be responsible for material duly consigned to the warehouse. Article 20: The exhibitor is obliged to detail in duplicate on company letter headed paper, machines, cash registers, computers, videos and any other suchlike entering the Fair site. One of the copies will be sealed and signed by the Superintendent of The International Book Fair Venezuela 2005 and will remain in the possession of the exhibitor, who must show this to security staff to be able to remove any of this equipment from the Fair site. This condition does not determine any responsibility of the ORGANISING BODY for any robbery, theft or damage produced during the showing of such. Article 21: Exhibitors may contract, at their own cost, security services de for their stand. The carrying out of these services must be approved by the ORGANISING BODY and will be subordinate to the security staff of the ORGANISING BODY. Article 22: Those in charge of the stands should be on the International Book Fair site one (1) hour before the opening to the public and may remain there until one (1) after closing. During the hours closed to the public, only the ORGANIZING BODY's security personnel will be allowed to remain on the Fair site. Article 23: The ORGANIZING BODY will take out and pay for an insurance policy to cover any general risks at The International Book Fair Venezuela 2005. Exhibitors may take out and pay for an insurance policy, that more amply covers the goods they are to include in their stands, as well as any other policy deemed necessary for any specific exigencies. Article 24: The ORGANIZING BODY will be responsible for the cleaning general maintenance of the Fair site.
CHAPTER VI Article 25: For the setting up of material to exhibit, the stands will be available on the day and at the times stipulated by The ORGANIZING BODY in the respective leasing contract. Exhibitors, who require more time, should request authorization in writing from The ORGANIZING BODY. Article 26: Dismantling should be carried out during the times and on the day stipulated in the leasing contract. At any time afterwards, the ORGANIZING BODY will not be held responsible for materials left by exhibitors on the Fair site
CHAPTER VII Article 27: The ORGANIZING BODY will provide a general warehouse on the Fair site for the use of all exhibitors. The ORGANIZING BODY will be responsible for all material duly consigned to said warehouse in sealed boxes, numbered, with the name of the publishers and country it belongs to. Under no circumstance will it be permitted to remove loose books or those found outside their box. Article 28: Access into the warehouse from outside, during opening times at the Fair is only permitted for the deposit of materials. The removal of material to the stands is expressly prohibited during opening times to the public.
CHAPTER VIII Article 29: The ORGANIZING BODY will charge no commission or fees whatsoever for any commercial transaction or negotiation that exhibitors undertake during the period of The International Book Fair Venezuela 2005 Article 31: Exhibitors are obliged to comply with the present Regulations, National laws and, the Regulations for the use of Recreation Parks , municipal bye-laws, and all current statutes in the República Bolivariana de Venezuela. |
